About Scott

Before joining Breit Biniazan, accomplished trial lawyer Scott Perry served as a founding partner of Perry Charnoff, PLLC. Known for his tenacity in the courtroom, Perry was honored with membership in the Inner Circle of Advocates, a prestigious group comprising the top 100 plaintiff trial lawyers in the United States. This elite group includes attorneys who have consistently achieved record-breaking verdicts and settlements nationwide, reflecting Perry’s reputation for delivering justice to his clients.

Perry’s partnership with Breit Biniazan has allowed him to expand his impact, bringing together like-minded attorneys who are dedicated to elevating trial practice standards and challenging the status quo. Perry’s relentless commitment to justice is evidenced in his recent work alongside the Breit Biniazan team on a landmark case against Cumberland Hospital and Dr. Daniel Davidow. On September 27, 2024, a Richmond Circuit Court jury awarded a record-breaking $360 million in a civil trial against Cumberland Hospital and Davidow, finding that the former medical director had sexually abused multiple plaintiffs under the guise of medical procedures. This unprecedented verdict underscored the need for transparency and accountability in youth residential care, setting a powerful precedent for other organizations. Perry and the team at Breit Biniazan represent over 40 additional plaintiffs against Cumberland and its parent company UHS, Inc., seeking justice and further reparations that total in excess of $930 million.

A skilled litigator, Scott has repeatedly achieved multi-million-dollar verdicts and settlements for his clients in cases involving catastrophic injury, wrongful death, and product liability. Other notable results include:

  • $360 million jury verdict in an institutional sex abuse case
  • $35.6 million jury verdict for a client with catastrophic injuries
  • $28 million settlement in a product liability case
  • $16 million settlement for a young man with injuries sustained during routine hospitalization
  • $12 million medical malpractice verdict for the family of a young mother who lost her life to an undiagnosed blood clot
  • $10 million jury award for a permanently injured student
  • $6.5 million settlement in wrongful death case
  • $7.8 million settlement in a surgical fatality case
  • $4.5 million for two sexual abuse victims with disabilities
  • $4.0 million settlement for woman who died during child birth
  • $3 million medical malpractice award for a family after a fatal surgical error
  • $2 million settlement for man whose cancer was misdiagnosed
  • $2 million verdict for a woman whose leg was amputated due to a misdiagnosed blood clot
  • Additional seven-figure awards for traumatic brain injuries, surgical negligence, and wrongful death cases

A Commitment to Standing Up for Families and Making Change

Perry’s focus on catastrophic injury and wrongful death cases stems from his dedication to serving families facing unimaginable hardship. His background includes several cases in which he secured both justice for families and prompted safety reforms. One such case involved the tragic drowning of an 18-year-old rowing coach; Perry successfully argued for the implementation of new safety standards within the sport, pushing defendants to institute changes to prevent future tragedies.

Understanding firsthand the long-term challenges that traumatic injuries bring, Perry is also a dedicated advocate for brain injury support services. With a brain-injury survivor in his family, he actively supports Brain Injury Services, a nonprofit organization helping individuals rebuild their lives after trauma.

Leveling the Playing Field

Scott believes strongly in the power of trial lawyers and the jury system to level the playing field against wealthy, well-represented corporations. His “David and Goliath” approach to litigation drives him to prepare every case for trial, challenging defense attorneys to negotiate fairly from the outset. This approach has earned him long standing recognition in the legal community, including consistent recognition as a “Super Lawyer” in Virginia and Washington, D.C. as well as the Best Lawyers list including the 2019 title of Medical Malpractice Lawyer of the Year.

As a board-certified Civil Trial Lawyer, Perry has demonstrated an expert level of skill and experience within this challenging practice area, a distinction few attorneys achieve. His invitation to the Inner Circle of Advocates highlights his proven success as one of the top plaintiff trial lawyers nationwide, one of only two attorneys from Virginia to receive this honor alongside his Partner, Jeffrey Breit.

Perry resides in Northern Virginia with his wife JoAnn and their two children. Outside the courtroom, he’s an avid exercise enthusiast, spending his free time hiking with his family and prioritizing well-being, just as he does for his clients in the courtroom.
